Privacy and terms.
Effective October 2026.
Scope
This page sets out how Tangible Communications (“Tangible”, “we”, “us”) handles information, and the terms on which this website and the Tangible client portal (together, the “Services”) are provided. By using the Services you agree to these terms. Where a signed agreement or accepted quote between you and Tangible covers the same subject, that agreement governs.
Information you provide
When you contact Tangible through this site, by email, or through the client portal, we receive the information you choose to send, typically your name, company, email address, messages, files, answers to questions, and notes on work in review. We use it to respond to you, to deliver and improve the work, to invoice and collect payment, and to keep records of the engagement. We do not sell personal information, and we do not use it for advertising.
The client portal
The portal holds the work for your engagement, along with messages, files, quotes, invoices and review notes. Access is limited to the people invited to your workspace and to Tangible. You are responsible for the people you invite, for keeping your sign-in to yourself, and for the content you and your colleagues add. Tell us promptly if you believe someone has access who should not.
Information collected automatically
The Services are hosted on Netlify, which processes standard technical data such as IP addresses and request logs to serve them securely. Typefaces are served by Google Fonts, which receives the technical request data needed to deliver them. The portal records sign-ins and activity on your workspace, such as when an item is opened, answered or approved, so that both parties have an accurate record. This site sets no advertising or analytics cookies.
Service providers and tools
We rely on third-party providers to run the Services, including providers of hosting, database and file storage, email delivery, accounting, payment processing and software tools. These providers process information on our behalf and only as needed to provide their service. Payments are handled by the payment processor; Tangible does not store full card or bank account numbers.
Tangible uses software tools to help prepare work, including automated and AI-assisted tools such as Tangible Copilot, which drafts revisions, questions and summaries from the information in your workspace. A person at Tangible reviews every change before it is shared with you. Content you provide may be processed by these tools for that purpose. It is not used by Tangible to train them.
Security
We use reasonable technical and organisational measures to protect the information we hold, including encrypted connections, access controls and limited staff access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Retention
Correspondence and workspace content are kept for as long as they are relevant to the relationship and to our legal, accounting and tax obligations, then deleted in the ordinary course of business.
Your choices
You may request a copy of the information we hold about you, or ask that it be corrected or deleted, by writing to engage@tangiblecommunications.com. Some records, such as invoices and signed agreements, may need to be kept for legal or accounting reasons.
Your content and approvals
You keep ownership of the content you provide. You confirm that you have the right to provide it and that Tangible may use it to perform the work, including any names, logos, photographs, figures, certifications and statements about third parties. You are responsible for reviewing work before you approve it, including its accuracy, claims, specifications, prices and compliance with any law, standard or third-party right that applies to your business. Approval of a deliverable, page or change confirms that it may be used or published as approved.
No warranty
The Services and any drafts, previews, comps, suggestions and summaries are provided “as is” and “as available”. To the fullest extent permitted by law, Tangible disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Drafts and suggestions, including those prepared with software tools, may contain errors and are not professional, legal, engineering, safety or financial advice.
Limitation of liability
To the fullest extent permitted by law, Tangible and its owners, staff and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or related to the Services or the work, however caused and on any theory of liability, even if advised of the possibility. Tangible is not responsible for content supplied or approved by you, for decisions made on the basis of drafts or suggestions, for third-party services, or for any outage, delay or loss of data outside its reasonable control. Tangible’s total liability for any claim arising out of or related to the Services or the work will not exceed the amount you paid Tangible for the work giving rise to the claim in the three months before the claim arose.
Indemnity
You agree to indemnify and hold harmless Tangible from claims, losses and costs, including reasonable legal fees, arising from content you provide, from your use of the Services or the work, or from your breach of these terms.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.
Changes
We may update this page as the Services change. The effective date above reflects the most recent revision. Continued use of the Services after a change means you accept the updated terms.
